Who Regulates What in Nigerian Media and Advertising?

No single regulator clears every Nigerian media or advertising project. Route the work according to what the message claims, where it will appear, whether it collects personal data, which protected material it uses, and whether the product belongs to a specially regulated sector.

The answer changes when the campaign, cut, channel, audience or product changes. A social video may involve ARCON, a sector regulator, consumer-protection law, data-protection duties and copyright permissions at once. Treat this guide as a routing tool, not legal advice, and obtain qualified Nigerian advice where the exposure is significant or the rules are disputed.

Use the Claim-Channel-Data-Rights route

The Claim-Channel-Data-Rights route is an editorial method proposed here, not an official compliance standard. Ask four questions before production begins:

  1. Claim: What is being promised, compared or implied, and what product or service is promoted?
  2. Channel: Is it an advertisement, broadcast, film exhibition, telecommunications service, billboard, political campaign or platform post?
  3. Data: Are you collecting, matching, profiling, retargeting or storing information about identifiable people?
  4. Rights: Who owns the music, footage, photographs, performance, script and creator identity, and what use has been licensed?

Each answer can trigger a different authority or private obligation. The route prevents a common error: asking only whether “the advert” was approved while ignoring product claims, audience data, distribution permits and third-party rights.

Read each source at the right level. A statute creates legal duties; a regulator's webpage usually explains procedure or guidance; a court report summarises a decision but is not the certified judgement; a platform rule governs use of that platform; and a contract allocates rights between its parties. One does not automatically satisfy another.

The regulator map

Authority Primary question Typical trigger What it does not replace
Advertising Regulatory Council of Nigeria, ARCON Does ARCON law or procedure apply, and is pre-exposure approval required? Paid or commercial communication directed at the Nigerian market Product approval, broadcast licensing, data protection or copyright permission
National Broadcasting Commission, NBC Is a licensed broadcaster and its transmitted content complying with broadcast law and applicable NBC instruments? Radio or television station, scheduled broadcast or broadcast licence General approval of every internet post
National Film and Video Censors Board, NFVCB Has a film or video work been classified, and is its distributor or exhibitor properly licensed? Film or video distribution and public exhibition Advertising approval or ownership of the film's music and footage
Nigerian Communications Commission, communications NCC Is a communications network, service, spectrum use or licensee compliant? Telecoms, internet service, short-code or other licensed communications service Editorial clearance of an advertisement merely because it appears online
Federal Competition and Consumer Protection Commission, FCCPC Are consumer representations and market conduct fair rather than misleading or abusive? Product claims, pricing, terms, promotions and consumer complaints Sector-specific approval or advertising vetting
Nigeria Data Protection Commission, NDPC Is personal data processed lawfully, fairly and securely? Lead forms, mailing lists, pixels, profiling, audience matching, competitions and customer databases Permission to use music, a creator's likeness or an advertising claim
Nigerian Copyright Commission, copyright NCC Are copyright administration, licensing and enforcement issues addressed? Music, photographs, film clips, illustrations, scripts, broadcasts and online infringement Contract approval, data protection or advertising vetting

The two commissions abbreviated “NCC” are different bodies. Write communications NCC for the Nigerian Communications Commission and copyright NCC for the Nigerian Copyright Commission in internal briefs so that approvals are not sent to the wrong team.

ARCON: the commercial message and advertising practice

The Advertising Regulatory Council of Nigeria Act 2022 establishes ARCON and covers standards, registration, offences, the Advertising Standards Panel and sanctions connected to unauthorised exposure. ARCON separately publishes a pre-exposure vetting procedure. That webpage is the regulator's stated procedure, while the Act is the statute.

As an editorial routing rule, start with ARCON when the work is a paid advertisement, sales promotion, sponsored creator communication or other marketing communication aimed at Nigeria. Do not assume that calling a video “content” removes its commercial character. Record the sponsor, consideration, claim, intended media, versions, territory and approval evidence.

The legal boundary of digital enforcement has been contested. In June 2026, a Federal High Court nullified a specific ₦60 billion sanction against Facebook Nigeria. TheCable's report identifies evidential, statutory-power and fair-hearing defects, but the linked article is a news report rather than the certified judgement. The reported ruling did not erase the ARCON Act or create a blanket exemption for online advertisements. Obtain current advice for a disputed digital route rather than turning one reported decision into a general slogan.

NBC: the broadcaster and the transmitted programme

The National Broadcasting Commission Act gives NBC responsibility for broadcast regulation and radio and television licensing, including power to establish a national broadcasting code. NBC hosts a 2020 addendum to the sixth edition of the Nigeria Broadcasting Code, while its service charter describes monitoring and complaint processes (NBC). An NBC-hosted journal article reports that a Federal High Court nullified the 2020 addendum. That article is secondary reporting, not the judgement or an appeal record, so confirm the current instrument and enforceability of any disputed clause before relying on it.

A brand, producer and station may therefore have different responsibilities. ARCON concerns the advertisement; NBC concerns the broadcaster, broadcast service and transmitted content; a product regulator may still control the underlying claim. Put the approved master, station-ready version, schedule, substantiation and traffic instructions in one version register. A last-minute edit can invalidate the value of an earlier review.

NFVCB: film and video classification, distribution and exhibition

NFVCB states that film and video works must be classified before distribution or exhibition in Nigeria, and it licenses distributor categories including online, national, regional and community distribution (NFVCB). Its published approval lists show title, language, duration, rating and consumer advice, making the classification visible to distributors and audiences (NFVCB approved films).

Classification is not a copyright licence, and it does not clear an advertisement promoting the release. A producer should keep the classified version, certificate, rating, consumer advice, distributor licence and delivery files aligned. A changed cut, trailer or exhibition route may create a new question that the original paperwork does not answer.

Communications NCC: networks and services, not every online message

The Nigerian Communications Act 2003 gives the communications NCC responsibility for communications services, networks, licensing, spectrum and consumer interests in that sector. Its published licensing frameworks cover services such as internet provision, value-added services and short-code operations (NCC licensing frameworks).

An advertisement delivered through the internet does not automatically become a telecommunications-licensing matter for the advertiser. The trigger is usually the regulated communications service or infrastructure. A short-code competition, bulk-message service or telecoms offer can bring the communications NCC into a project while ARCON, NDPC and FCCPC remain relevant to other parts.

FCCPC: the consumer claim still has to be fair

The Federal Competition and Consumer Protection Act 2018 is Nigeria's federal competition and consumer-protection statute. Sections 123 to 126 address false or misleading marketing representations, coercive conduct, uncorrected misapprehensions and unsupported performance claims or testimonials.

An approval does not turn weak evidence into a true claim. Keep the research, test conditions, price period, stock limits, comparison basis and terms that support each statement. If a creator says a product produced a personal result, the team must establish whether that experience is authentic, representative enough for the wording used and permitted by the relevant sector rules.

NDPC: campaigns that collect or target people

The Nigeria Data Protection Act 2023 regulates processing of personal data and establishes the NDPC. The Commission summarises rights including information, access, rectification, objection, restriction, portability, erasure and safeguards around automated decision-making (NDPC).

A newsletter form, giveaway entry, custom audience, customer upload, location segment or influencer-event guest list can involve personal data. Before collection, name the controller and processors, lawful basis, purpose, fields, recipients, retention period, security measures and rights route. Consent is not a decorative checkbox, and consent is not the only lawful basis. The correct basis depends on the processing and must be documented.

Copyright NCC: permission for the material inside the work

The Copyright Act 2022 covers protected works, ownership, assignments, licences, infringement, performers' rights and online content. The copyright NCC administers and enforces that framework (Nigerian Copyright Commission).

Public availability is not permission. As an editorial clearance control, identify the work, owner, performer or other contributor, licence scope, territory, duration, media, editing permission and paid-amplification use. Whether a one-post agreement permits recutting, paid advertising or reuse in another country is a contract-scope question. Do not assume those rights unless the agreement and relevant rights licences grant them.

Product, election and outdoor rules add another layer

Some campaigns require a sector regulator in addition to the bodies above.

  • The NAFDAC Act gives the agency functions that include regulating advertisements for food, drugs, cosmetics, medical devices, packaged water, chemicals and detergents. NAFDAC separately publishes product-specific procedures and guidance (NAFDAC mandate, NAFDAC guidelines).
  • The Securities and Exchange Commission regulates capital-market promotions. Its 2026 notice says only registered entities may promote investment services, advise or solicit public funds under the applicable framework (SEC Nigeria).
  • INEC monitors political campaigns and issues rules governing political parties. Its official political-party document register lists the 2026 Regulations and Guidelines for Political Parties (INEC). Check the Electoral Act, the current INEC instrument and any election-specific direction rather than treating general advertising guidance as the complete political-campaign rulebook.
  • State and local outdoor rules may apply to placement. In Lagos, LASAA's published rules cover permits for outdoor structures, including billboards and temporary signs (LASAA). Do not assume the Lagos process is the process in every state.

Worked routing sheet: a creator-led supplement campaign

Assume a registered supplement brand commissions a creator video, pays to amplify it, collects competition entries and adapts it for radio and a Lagos billboard. This is an illustrative editorial routing sheet, not a statement that every listed submission is mandatory in every case.

Workstream Route before release Evidence owner Stop condition
Product and health claims NAFDAC requirements plus claim substantiation Brand regulatory lead Product, claim or approval status cannot be verified
Advertisement and creator execution ARCON vetting where required, applicable disclosure rules and approved versions Agency compliance lead Posted or amplified file differs materially from approved master
Radio cut Current NBC and broadcaster requirements plus ARCON and NAFDAC evidence Media agency and station Station-ready version or mandatory wording is missing
Competition form and retargeting NDPC data map, notice, lawful basis, processors and retention Brand data controller Controller, purpose or deletion route is undefined
Music, footage and likeness Copyright and contract licences for organic and paid uses Producer or rights lead Territory, term, media or edit rights are absent
Lagos billboard LASAA/site-owner permit route and approved artwork Out-of-home operator Site or display permit is unconfirmed
Offer and terms FCCPC fairness check, visible material conditions and complaint route Brand legal and customer team Price, availability or material limitation is misleading

The platform's branded-content tool remains a platform rule. The creator agreement remains a contract. Neither replaces statutory duties, and statutory approval does not repair an inadequate contract.

Run an eight-day internal routing sprint

This schedule organises the team's work. It does not shorten a regulator's processing time or promise that every approval will arrive by day eight.

  1. Day one: freeze the objective, product, territories, audiences and every planned channel.
  2. Day two: complete the Claim-Channel-Data-Rights route and identify the responsible person for each answer.
  3. Days three and four: prepare claim substantiation, scripts, rough cuts, product status, rights documents and data-flow map.
  4. Days five and six: make required submissions and broadcaster, distributor, platform or outdoor-operator checks. Record reference numbers and versions.
  5. Day seven: reconcile all conditions into a release matrix covering copy, cut, rating, warning, disclosure, territory and expiry.
  6. Day eight: give internal release approval only to files that match the matrix and have received every external approval already due, then retain evidence of what actually ran.

The decision point is whether every triggered route has a named owner, authoritative requirement, approved version and recoverable record. If any one is missing, hold that placement rather than assuming another regulator's approval covers it.

FAQs

Does ARCON approval mean a product claim is approved by NAFDAC?

No. Advertising regulation and product-specific regulation are separate routes. A NAFDAC-regulated product may require both product or claim clearance and advertising review.

Does a creator need to treat a gifted product as advertising?

Do not decide from the word “gift” alone. Examine the commercial relationship, requested deliverables, editorial control, disclosure duty and applicable ARCON, sector and platform rules.

Does a platform disclosure label settle Nigerian compliance?

No. It may satisfy a platform requirement or help disclose the relationship, but it does not replace Nigerian advertising, product, consumer, data or rights obligations.

Which NCC should receive a complaint?

Use the Nigerian Communications Commission for communications services and licensees. Use the Nigerian Copyright Commission for copyright administration or infringement. State the full name in correspondence.
